बजट में सभी कानूनों के कंप्लायंस को सरल करना अत्यंत आवश्यक, जमीनी हकीकत पर सरकार ध्यान दे
वर्तमान समय में व्यापार जगत में चर्चा स्लोडाउन की बहुत हो रही है। व्यापार मंदा है या स्मूथ तरीके से नहीं चलाया जा रहा है। आपसी विश्वास की कमी हो गई है। उधार लेने-देने में हिचक है।

आइए जानते हैं क्या सुझाव हैं एक्सपर्ट के...
वर्तमान समय में व्यापारी व्यपार करना चाहता है, लेकिन कंप्लायंस में वह अपने आपसे डरने लगा है। इसलिए वह व्यापार को बढ़ाना नहीं चाह रहा है, जिससे व्यापार में कहीं ना कहीं शिथिलता दिखाई देती है। जैसे- शेयर मार्केट के अंतर्गत एक ही व्यापार की एकाउंटिंग और उसको बाईफरकेशन करना पड़ता है।

लांग टर्म कैपिटल गेन, शोर्ट टर्म कैपिटल गेन, इंट्राडे ट्रेडिंग को कैश सेगमेंट में स्पेकुलेटिव, डेरीवेटिव फ्यूचर को व्यापारिक लाभ मानना पड़ता है। इसका अलग-अलग तरीके से हिसाब पेश करना बहुत बड़ा सरदर्द है। सामान्त: शेयर मार्केट का काम मुख्य व्यापार नहीं होता है। यह एक इन्वेस्टमेंट का जरिया है इसलिए जैसा ब्रोकर हिसाब देता है, उसी को मान्य किया जाना चाहिए।

अच्छा व्यक्ति नहीं लेना चाहता लोन : बैंकिंग की रिकवरी इतनी जटिल कर दी है की अच्छा व्यक्ति लोन लेना नहीं चाहता है। एनपीए के 90 दिन के नियम को भी परिवर्तन करने की अत्यंत आवश्यकता है। आज की परिस्थिति में वह लिए हुए लोन को वापस भरकर शांति से जीना चाह रहा है। वह नया लोन नहीं लेना चाह रहा है। इससे व्यक्ति की उद्यमिता और उत्साह में कमी आ रही है।

जिसकी वर्थ नहीं है, जिसके पास व्यवस्थित व्यापारिक रणनीति नहीं है, जिसकी लोन की पात्रता नहीं है, वह लोन लेने के लिए खड़ा है। लोन की पात्रता का आकलन मुख्य रूप से आयकर रिटर्न माना जाता है। इसलिए कई लोग आय नहीं होने पर भी आयकर का रिटर्न भरते हैं। इसलिए बैंकिंग लोन देने की पात्रता के कैलकुलेशन को मूल रूप समय के साथ बदलने की जरूरत है।

संशय के कारण घटा व्यवहार : व्यापार जब से आयकर में नोटबंदी के दौरान करीब 77.50% टैक्स धारा 115BBE के अंतर्गत लेने का नियम आर्डिनेंस के माध्यम से लाया गया था, जिसका उद्देश्य बेनामी नगदी को रोकना था। लोगों से स्वेच्छा से डिक्लेरेशन करवाना था। व्यापार आपसी उधारी (मॉल के पेटे या अन्य) लेने-देने से चलता है। इस तरह के ट्रांजेक्शन पर भी इसी नियम (77.50% वाला) को लागू करना नहीं चाहिए।

इस नियम का व्यापार जगत में दुष्प्रभाव यह हो रहा है कि लोगों ने आपस में संशय के कारण व्यवहार कम कर दिए, जिसका परिणाम व्यापार में तरलता की कमी हो गई है। उत्साह कम है, आयकर में टैक्स स्लैब अब मुख्य मुद्दा नहीं है अब पेनल्टी और अत्यधिक कंप्लायंस मुख्य मुद्दा है।

व्यापार के स्वभाव के अनुसार कंप्लायंस का रास्ता प्रोविजन के माध्यम से निकालना चाहिए। असेसमेंट के दौरान किए गए एडीशन पर टैक्स की राशि पर ब्याज की राशि असेसमेंट के दिन से लेना चाहिए ना कि संबंधित पुराने वर्षों से।

पेनल्टी को भी कम करना : इससे लोग अपील करने की बजाय टैक्स भरकर छुटकारा पाने में ज्यादा तत्पर रहेंगे।GST के अंतर्गत ब्याज 18%-24% बहुत ज्यादा है। GST में एक अलग से रिवाइज्ड रिटर्न भरने की सुविधा पोर्टल में देना ही चाहिए, जिसके माध्यम से व्यक्ति अपनी गलती को सुधार सके। 3बी फॉर्मेट के कारण बहुत गलतियां हुई हैं। व्यक्ति गलती के कारण अपने ही पैसे पर ब्याज देकर पैसा भरना और बाद में रिफंड लेने का मन नहीं बना पा रहा है।
